Watching the Leicester game and it seems that more often these days we're seeing fouls given for a 'high foot', yet what actually constitutes a high foot? In my mind it should be a certain height between grass and boot, yet I'm seeing them given when the opposing player is almost laying down and the boot is barely 2 inches from the grass.

It just seems like refs award a free kick if a boot gets too near to a head regardless of where the head is, which isn't a fair way of doing things because it basically means you can't challenge for the ball properly unless your opponent is upright, what do the rules state?
