Here we go again!

Argyle have another date in the High Court on Thursday 5th May. Unexpected or planned?
The day before the creditors meeting as well, something's going on or maybe just procedure.

It is unclear what this latest visit to court is about but it is listed as follows:
High Court of Justice – Chancery Division, court 35 before Mr Justice Newey, starting at 10.30am. Plymouth Argyle Football Club Ltd
Re: Company No. 1382/2011.

Several cases are due to be heard before Argyle including The Commissioners for HM Revenue and Customs v The Football League Ltd.

Link.

There isn't a company called Plymouth Argyle Football Club Ltd. HMRC made that mistake last time in March, is it them after us again, the day before the CVA meeting?

It looks horribly like that "Football Creditors" ruling again, only this time they have targeted the Football League immediately prior to an application re PAFC.

Sounds like they are going for the jugular, get the football creditors "secured" status unsecured and then use poor old us as a precedent.

Only a hunch mind.

It could be a legal challenge to the CVA, HMRC have done that before. Lots to be learnt from here.

Just as well we had a tax specialist running the club all these years, imagine the mess we would be in otherwise.

Well done Ian for picking this up (again) have you let the club know?

My initial reaction was HMRC but is it possible this could be Buttivant challenging the process BG has used if he thinks things have been unfair?

The case is being heard in the Companies Court

Companies Court - deals with the compulsory liquidation winding up of companies and other matters under the Insolvency Act 1986, Companies Acts 1985 and 2006, Company Directors Disqualification Act 1986 and the Financial Services and Markets Act 2000.

Re: Company 3287/2011
Re: Company 3343/2011

To me then this is either a case of HMRC tying up lose ends regarding us or a total challenge on the football creditors ruling. Can't imagine this having any impact on tomorrows dealings.

SG - def not a winding up pettition, the debt we owe isn't enough and besides they can't issue one while we are in admin.
