As usual a comment from someone one there about the article, who seems not to have read it at all or understand anything about what has happened in the past or what the trust is about

The trust really should be looking into making legal claims against P&A for stress caused by the receipt and content of these letters. The Herald is all very well, but there is a genuine case to sue P&A, and it is disapointing not to see the Trust really go for the throat. A lot of people who recieve these letters dont read this site and may have felt pressured into playing, a little bit of half hearted local coverage isnt going to help.

To be fair to the trust they have taken it to the press, they have said that they will help its members and are considering legal support. It doubt if it can take the legal route until it has all the facts and obviously until members contact them they cannot represent them legally. Personally I think what the trust have done so far is spot on.

We also don't know what was actually said by Woz in the interview and how much has been edited, however it is front page of the Herald which is exactly where it needs to be to reach members who do not use PASOTI

Are P and A acting on their own by issuing these demands or are they under instructions from someone else?
Now we are out of administration would the old board of directors have any financial claim on use of parts of Home Park by fans etc while we were in admin?

It doesn't seem right that there is proof that these bills have been paid but P and A still issued the invoices. Are they that stupid?
When the original bills were paid were they paid to P and A?

same as ian i owe nothing to this company and have proof of payment of my bill in full. Well done to the trust forbringing this out locally first then hopefully more people will come forward and then as a group we can humiliate this company. Personally i shall try contacting them in the new year and if they wont respond to my phone call i shall get advice then just sit back and let them dig a bigger hole for themselves.

To claim damages, I think the lawyers out there will say, you need to claim loss/hurt. If someone suffers a mental breakdown because of the duress of receiving such a letter from P & A and has proof, by a statement from a doctor, then they might be in with a shout. Otherwise, I rather think they will be on weak ground.

Unfortunately, mere distress isn't grounds for action in Tort Law. You'd need to prove that the sending of the letter was negligent (I'd hazard a guess it is), that the harm was forseeable, and that it caused a medically recognised psychological disorder (post-traumatic stress, etc). As much as this could distress people, I doubt very much reading one of these letters would bring about a medically recognised psychological condition.

Rather than the courts, I feel that humiliating these incompetants by trash-talking them to the press and all decent football fans is the best course of action. I'm still fuming about this, sending these letters on Christmas Eve makes Guilfoyle and his cronies sub-human in my book.

The Sheffield-based firm recouped only a fraction of the fees it racked up during the administration as part of Mr Brent's buyout, agreeing to write-off around half its costs.


That's being slightly nice, I'd have thought their costs were covered. What wasn't covered was the ridiculous wages they paid themselves for failing to do their job properly :crazy:

I see from the EH article that the deadline for payment is by 12th January.
Two things spring to mind.
Firstly, it's a bit of a joke because we all know that PandA don't do deadlines very well :lol:
Secondly, what date is the 'ginger dwarf' in court for the winding up order of TCFC? Coincidence? :think:
